1. Acceptance of Terms
By downloading, accessing, or using TrackFit AI, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.
2. About TrackFit AI
TrackFit AI is a creator audio workflow application designed to help users fit music and audio to specific durations for podcasts, videos, intros, outros, transitions, spoken-word content, presentations, social media content, and related creator workflows.
Features may include audio uploading, waveform analysis, AI-assisted music fitting, audio restructuring, narration blending, preview generation, exports, creator presets, and subscription-based premium functionality.
3. User-Uploaded Audio and Content Rights
TrackFit AI does not provide copyrighted music content and is not a music streaming service. Users upload their own audio files and content.
You are solely responsible for ensuring that you own, license, or otherwise have permission to upload, process, modify, export, store, distribute, or use any audio or content submitted through the app.
You retain ownership of audio files you upload. By uploading audio to TrackFit AI, you grant Blue Orchard Innovations, Inc. a limited, non-exclusive right to process that audio solely as necessary to provide app functionality, previews, exports, diagnostics, support, storage, synchronization, security, and related services.
TrackFit AI may not be used to evade copyright restrictions, remove rights-management protections, create unauthorized derivative works, or prepare infringing content for distribution.
4. Prohibited Uses
You agree not to use TrackFit AI to:
- Upload or process content you do not have the legal right to use.
- Violate copyright, trademark, publicity, privacy, licensing, or other legal rights.
- Remove, bypass, disable, or defeat digital rights management (DRM), watermarking, platform protections, copy protection systems, or other access-control technologies.
- Attempt to bypass subscription access controls, usage limits, security protections, or entitlement validation systems.
- Reverse engineer, scrape, overload, interfere with, or disrupt the app or related services.
- Use the app for unlawful, abusive, deceptive, infringing, harmful, or unauthorized activity.
5. Free and Paid Features
TrackFit AI may offer both free and paid features. Free access may include limited uploads, previews, exports, processing limits, file duration limits, file size limits, output formats, or restricted workflow functionality.
Paid access may unlock additional functionality including AI Music Fit, Podcast Segment Builder, creator presets, WAV export, stereo export, expanded usage limits, longer uploads, enhanced workflows, or future premium features.
Features, limits, pricing, functionality, and subscription offerings may change over time as the app evolves.
6. Auto-Renewable Subscriptions
TrackFit AI offers auto-renewable subscriptions under the “TrackFit AI Creator” plan.
- Monthly Subscription: $9.99 per month
- Annual Subscription: $79.99 per year
Prices may vary by country, region, currency, taxes, promotional pricing, or App Store storefront.
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current period.
Your subscription will continue until canceled through your Apple ID subscription settings.
You can manage or cancel your subscription through your Apple ID account settings. Deleting the app does not cancel your subscription.
Refund requests, billing disputes, cancellations, and subscription management are handled by Apple according to Apple’s policies and procedures.
Any subscription price changes will be handled through Apple’s App Store subscription systems and notices where required.
7. Subscription Access and Restore Purchases
Subscription access is validated through Apple App Store subscriptions and RevenueCat entitlement validation systems.
If premium access does not appear after purchase, users should use the “Restore Purchases” feature within the app.
Subscription verification and entitlement restoration may require an active internet connection.
8. Usage Limits and Service Protection
TrackFit AI may apply limits to uploads, previews, exports, processing duration, file sizes, storage, AI-assisted features, usage frequency, or other resource-intensive functionality.
These protections are intended to maintain service reliability, control infrastructure costs, prevent abuse, protect system performance, and ensure fair usage.
9. Availability and Changes
We may modify, update, suspend, discontinue, or replace app functionality, subscription offerings, supported formats, features, or pricing at any time.
We will make reasonable efforts to maintain reliable app availability, but we do not guarantee uninterrupted or error-free operation.
Certain features may require internet access, platform support, updated operating systems, or compatible hardware.
10. No Professional Audio Guarantee
TrackFit AI is designed to assist creator audio workflows, but output quality may vary depending on source material, audio quality, structure, formatting, settings, user selections, processing conditions, and device capabilities.
We do not guarantee that processed audio will satisfy professional broadcast, licensing, legal, commercial, platform, or production standards.
11. Intellectual Property
TrackFit AI, including its branding, interface, software, processing workflows, designs, features, graphics, technology, and related materials, is owned by Blue Orchard Innovations, Inc. or its licensors and protected by applicable intellectual property laws.
Except where permitted by law, you may not copy, distribute, lease, sublicense, modify, reverse engineer, decompile, create derivative works from, or commercially exploit the app or related services without written authorization.
12. Privacy
Your use of TrackFit AI is also governed by our Privacy Policy, which explains how information is collected, used, processed, stored, and protected.

13. Apple Standard EULA
For users who download TrackFit AI through the Apple App Store, use of the app is also governed by Apple’s Standard End User License Agreement unless superseded by a separate agreement.

14. Disclaimer of Warranties
TrackFit AI is provided “as is” and “as available.” To the maximum extent permitted by applicable law, Blue Orchard Innovations, Inc. disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, availability, reliability, non-infringement, uninterrupted service, and accuracy.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Blue Orchard Innovations, Inc. shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of business, loss of data, loss of content, interruption of service, claims related to uploaded audio, third-party rights disputes, copyright claims, or damages resulting from app use or inability to use the app.
16. Termination
We may suspend, restrict, or terminate access to TrackFit AI if we believe a user has violated these Terms, abused the service, attempted to bypass security or subscription systems, infringed third-party rights, or used the app unlawfully.
17. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date.
Continued use of TrackFit AI after updated Terms are posted constitutes acceptance of the revised Terms.
